The relevant Maine escheat legislation can be acquired from the Maine State Planning Office or the Maine Legislature. This law was repealed in 1995.
(REPEALED) 1866-A. Abandoned and unclaimed deposits; reports and payments
Deposits are presumed abandoned and are unclaimed deposits when retained by a manufacturer or distributor 60 days after being collected during any 3-month period ending the last day of March, June, September, or December. Deposit initiators pursuant to section 1863-A must report deposit related activity and disburse unclaimed deposits in accordance with the provisions of this section.
1. Reports. Each deposit initiator must report to the department on or before the 20 th day of March, June, September, and December the total amount of deposits paid to, refunds paid from and income earned on its deposit transaction account for the 3-month period ending the last day of March, June, September and December. Reports under this subsection must separate minimum deposits from other deposits collected and refunded.
2. Unclaimed deposits. Except for the initiators of deposit under section 1863-A, subsection 1, each deposit initiator shall pay to the Treasurer of State on or before the 20 th day of March, June, September and December an amount equal to 50% of the unclaimed minimum deposits held by the deposit initiator. The remaining unclaimed minimum deposits, any other unclaimed deposits and any income earned on deposits become the property of the distributor on the day payment is made to the Treasurer of State. Deposit initiators under section 1863-A, subsection 1 shall retain all unclaimed deposits. Funds received by the Treasurer of State under this subsection become the property of the State and must be deposited in the Maine Solid Waste Management Fund established in Title 38, section 2201.
3. Over-redemption of beverage container deposits. When a deposit initiator pays out more in refund values than it collects in deposits during the course of a calendar year, the deposit initiator may apply to the Treasurer of State for a reimbursement from the Maine Solid Waste Management Fund equal to the amount of over-redeemed minimum deposits. The Treasurer of State shall reimburse documented claims of over-redeemed minimum deposits.
